 Customer Survey Promotion

Terms and Conditions

1. This competition (Promotion) is conducted by Mitsubishi Motors Australia Ltd ABN 53 007 870 395 of 1 Sir Richard Williams Avenue, Adelaide Airport SA 5950 (Promoter).

2. Entry into the Promotion constitutes acceptance of these Terms and Conditions.

3. All entry instructions and prize information published by the Promoter for the Promotion forms part of these Terms and Conditions.

4. The Promotion is open to all Australian residents aged 18 years or over who receive an email from the Promotor inviting them to participate in a survey (Survey Invitation).

5. Employees and their immediate families of the Promoter, any Mitsubishi dealer or their agents are not eligible to enter the Promotion.  The Promoter reserves the right to request any entrant to provide documentary evidence confirming the entrant's age or satisfaction of any other entry conditions, and to disqualify any entrant who is does not provide acceptable evidence upon request.

6. The Promotion commences at 9am AEST on 16 January 2026 and closes at 9am AEST on 16 May 2026 (Promotion Period).

7. The Promotion is a game of chance.

8. To enter, an entrant must follow the link (URL) included in the Survey Invitation and fully complete the survey and submit the entrant's responses during the Promotion Period.  One entry is permitted per Survey Invitation.

9. During the Promotion Period, the Promoter will conduct a monthly prize draw where one valid entry will be drawn and the entrant who submitted that entry will receive a Visa® gift voucher to the value of AU$500 (Prize).  Prizes will be distributed electronically to Prize Winners via email.

10. Any survey submission will not result in a valid entry where it occurs outside the Promotion Period or where the entrant fails to complete all required information (in which case the entrant will not be eligible for any Prize).

11. All entries compliant with these Terms and Conditions will be entered into the draw, with the winner selected at random from eligible entries using electronic drawing software (Prize Winner).  The draw will be conducted using electronic drawing software which will select Prize Winners at random.

12. All prize draws will take place within 3 business days of the 16th for the previous month's winner at 1 Sir Richard Williams Avenue, Adelaide Airport SA 5950. A Prize Winner will be notified by the Promoter by email within [48 hours] of the draw using the contact details supplied at the time of entry in the Promotion. 

13. The Promoter will not be liable if the Promoter is unable to contact a Prize Winner due to incorrect or incomplete contact details.  The entrant will be responsible to notify the Promoter of any change to the entrant's contact details during the Promotion Period.

14. The details of the Prize Winner will be published on the Promoter's website within 30 days of the date of the relevant draw.

15. The Promoter's decision in relation to any aspect of the Promotion (including the validity of entries) is final and will be binding on all entrants.  No correspondence will be entered into by the Promoter in relation to any decision by the Promoter or any other aspect of the Promotion.

16. It is a condition of the Prize Winner being awarded the Prize that the Prize Winner agrees to these Terms and Conditions.

17. Acceptance and/or use of a Prize may require acceptance of third-party terms and conditions (for example, terms and conditions prescribed by Visa®) (Additional Terms).  Entrants acknowledge and agree that acceptance of any Additional Terms is a condition of acceptance or use of a Prize, and that an entrant may be unable to receive the benefit of the Prize if the entrant does not accept those Additional Terms.  Additional Terms are not prescribed by or within the control of the Promoter.

18. If a Prize Winner rejects the prize for whatever reason or does not claim their prize in accordance with the requirements of these Terms and Conditions or any notification or other instructions issued by the Promoter, their Prize will be forfeited.

19. If a Prize is forfeited, the Promoter may, in its sole discretion, select an alternate Prize Winner based on the same methodology as for selection of the original Prize Winner.  An alternate Prize Winner will be drawn at the same time and venue and using the same methodology as was used for the original Prize Winner, in case it is required.

20. Entrants will bear all costs of entry into the Promotion (including any fees for Internet access).

21. The Prize Winner must provide any information and cooperation reasonably required by the Promoter to arrange for the Prize to be provided to the Prize Winner, including any information required for the Promoter to procure the issue of the Prize to the Prize Winner.

22. The total value of the entire Prize pool is $2500.

23. Prizes are not transferable or exchangeable and cannot be taken as cash.

24. The Prize Winner consents to the Promoter using and/or publishing the Prize Winner's name (including as described in clause 14) and/or citing the Prize Winner's survey responses or any other statements, including for promotional purposes, in any form of media (including on social media).  It is a condition of acceptance of the Prize that the Prize Winner consents to any use, publication or broadcast of the Prize Winner's name and survey responses.

25. All entries become the property of the Promoter.  As a condition of entering into this Promotion, entrants agree to assign all their rights in and to their entry and any related content to the Promoter, including any copyright or other intellectual property rights in the entry and related content.  Entrants acknowledge and agree that the Promoter may use this content for any and all purposes including commercial purposes.  The entrant warrants that entry content is original, lawful and not misleading and that the Promoter's use of such content will not infringe the rights of any third parties.  The Promoter has no obligation to credit the entrant as the author of any content submitted and may engage in any acts or omissions which would otherwise constitute an infringement of any moral rights the entrant may have as an author of content.

26. Subject to any applicable law, regulation or permit condition, if for any reason beyond the control of the Promoter this Promotion is not capable of running as planned, including for any reason which affects the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion (subject to any direction given by a relevant regulatory authority) to cancel, terminate, modify or suspend the Promotion.

27. The Promotor does not exclude, restrict or modify the application of any statute, the exercise of any rights conferred by it, or any liability for failure to comply with it (including the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law) where to do so would breach that statute or cause any part of these Terms and Conditions to be void.

28. Except to the extent that clauses 27 or 29 apply, the Promoter excludes all liability arising in any way out of the Promotion, including all:

(a) statutory liability;

(b) tortious liability (including liability for negligence);

(c) guarantees, warranties, terms and conditions implied or imposed by statute, the general law, custom, or other source external to these Terms and Conditions; and

(d) liability for all economic, consequential, indirect, special or incidental losses, expenses, damages and costs,

including without limitation liability caused by or relating to:

(e) any technical difficulties or equipment malfunction;

(f) any theft, unauthorised access or third party interference;

(g) any entry that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter);

(h) any Prize delivery that is late, lost, altered, damaged or misdirected (including where any email from the Promoter is not received by the Prize Winner for any reason);

(i) any variation in Prize value to that stated in these Terms and Conditions;

(j) failure to use a Prize or any portion of it by its expiry date;

(k) Prize or use of a Prize by a winner, or loss of a Prize.  The Prize should be treated as cash, and the Promoter will not be responsible for (or replace) lost or stolen Prizes; and/or

(i) any tax implications.

29. Any liability that cannot be excluded under clause 28 by virtue of clause 27 is limited, at the Promotor's option, to the remedies specified in this clause.

(a) if the liability arose or breach occurred in respect of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or

(b) if the liability arose or breach occurred in respect of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

30. The exclusions and limitations of liability under this these Terms and Conditions operate in favour of the Promoter, its related bodies corporate, and their officers, employees, contractors and agents, and the Promoter holds the benefit conferred by this clause on trust for those persons, jointly and severally.

31. The Promoter may vary these Terms and Conditions in its discretion, including where it is reasonably necessary to reflect changes in the law or due to reasons outside of the Promoter's reasonable control.  The Promoter will communicate any changes to these Terms and Conditions via the Promoter's website or via email, and the entrant agrees that notification by email or publication of updated Terms and Conditions on the Promoter website will constitute sufficient notice of changes to these Terms and Conditions.

32. These Terms and Conditions constitute the entire agreement between the Promoter and entrant and will be governed by the laws of South Australia.  If any part of these Terms and Conditions are held to be invalid or unenforceable by a court of law, it will be severed and will not affect the remainder, which will continue in full force and effect.

33. The personal information the entrant provides in connection with the Promotion will be collected, stored and used in accordance with these Terms and Conditions and the Promoter's Privacy Policy, published at www.mitsubishi-motors.com.au/privacy-policy.  By entering the Promotion, all entrants agree to the use and disclosure of their personal information as described in these Terms and Conditions and the Promoter's Privacy Policy.  Where an entrant provides the personal information of any third party in connection with the Promotion, the entrant warrants that the Promoter's use of that personal information will not breach the Privacy Act or any other law.

34. Entrants acknowledge and agree to the following (Personal Information Collection Statement):

(a) We collect personal information in order to facilitate an entrant's entry into the Promotion, provide the entrant with a Prize (if the entrant is a Prize Winner), administer the Promotion, use survey responses to improve and develop our product and service offerings, and generally to facilitate our dealings and accomplish the purpose for which the personal information was provided to us.

(b) We may collect personal information from third parties (such as Mitsubishi dealers, or market research companies acting on our behalf) that have collected it from entrants.

(c) We may be unable to allow entrants to participate in the Promotion or deal with an entrant's request if the entrant does not provide the personal information we request.  Due to the nature of the Promotion and the Prizes, we cannot accept entries submitted anonymously or using a pseudonym.

(d) We may use the entrant's personal information for the purposes of direct marketing, and by providing us with personal information entrants consent to us doing so.  However, if an entrant does not wish to receive marketing or promotional communications from us, please notify us using the contact details below or use the opt out mechanism provided in those communications.

(e) We usually only disclose an entrant's personal information to authorised Mitsubishi dealers or agents, or contractors or subcontractors.  Generally we are not likely to disclose personal information to overseas recipients, however we may disclose personal information to our related bodies corporate in Japan.

(f) Our Privacy Policy contains information about how an entrant may access the entrant's personal information held by us and seek correction of such information.  It also contains information about how an entrant may complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint.
